Adoption creates a new family, and changes the life of the child and the adoptive parent in a profound way. While most family court litigation is contentious, an adoption is a happy and positive event.


Adoptions can take place in a variety of circumstances. It could be a single-parent adoption, adoption by a relative, step-parent, or foster parent, or a second-parent adoption for same-sex couples or couples who have utilized assisted reproductive technologies.

In order for a party to adopt, the biological parents’ rights have to first be terminated, or they have to specifically agree to the adoption. Then there must be a hearing to determine if the adoption is in the child’s best interest.

 

If you are the biological parent whose rights are being terminated, all hope is not lost. You may be able to enter into a Post-Adoptive Contact Agreement (PACA), which will give you the ability to still maintain contact with the child.
