Custody cases are one of the most intense and difficult areas of litigation, and they can arise in a variety of different circumstances.


A custody case will usually happen when parents are facing divorce. It can also arise when parents are not married, but in a relationship that ends.


Custody matters can also arise when grandparents seek primary or partial custody of their grandchildren, or when a third party who may not be related to the child but who takes care of the child decides to go to court to obtain custody.

Additionally, parents may have an existing custody order, but one of them may want to move out of the area, and this requires additional custody litigation to permit relocation.

 

And sometimes, in cases where parents are unmarried, but are still together in a relationship, one or both of them may want to obtain a court order to define custody while things are amicable.

 

There are also other many issues which can affect custody, such as substance abuse and addiction, physical, sexual, or emotional abuse, mental health issues, and any special needs of the child.
